Hazmat shippers face rising enforcement and potential shipping delays under the new U.S. DOT Enhanced Enforcement Authority Procedures rule. The March 3, 2011 rulemaking gives U.S. DOT inspectors broader authority to stop, open, and, detain non-compliant hazmat shipments during transit. All hazmat shippers, especially those transporting pharmaceuticals or other highly sensitive materials, must ensure all packages are in strict compliance with the rules. Failure to comply with the new rule will result in costly penalties, shipping delays, and returned shipments.

Companies that ship hazardous materials are required by law to ensure that their products are properly classified, described, packaged, marked, and labeled as prescribed by domestic and international standards. As per the U.S. DOT, hazmat training and documentation of training are mandatory requirements for employees who prepare hazardous materials for transport or sign shipping papers. Fines for non-compliance are now up to $55,000 per day, per violation for civil penalties and up to $110,000 per day, per violation for criminal penalties. Most carriers like UPS and FedEx will refuse any hazmat shipment offered by a company that cannot provide documentation of hazmat training for all hazmat employees.
